Terms of use

This is a courtesy translation. The French version, conditions d'utilisation, is the legally binding one.
1. The service
FramIQ is an iOS application for cycling bike fitting and postural analysis, published by Gaspard Blanc, sole trader, osteopath D.O. and bike fitter, trading under the business names FramIQ and OBF Studio. Both names refer to the same sole trader, fully identified in the legal notice.
FramIQ offers video posture analysis, frame comparison and cleat setup. Recommendations are provided for information only and do not constitute medical advice. Consult a qualified healthcare professional for any medical concern.
By downloading or using FramIQ, you accept these terms.
2. Access
FramIQ is intended for users aged 16 and over. By using the app you confirm that you meet this condition. Use is personal and non-commercial.
3. In-app purchases and subscriptions
Paid options are handled exclusively through Apple's in-app purchase system.

This is a one-off purchase, not a subscription. Access is personal and non-transferable.
Annual subscription, €89.00 per year

If you already made the one-off purchase, moving to the annual subscription costs €60.00.
On the wording "unlimited analyses": it means there is no permanent cap, not an infinite quota. If your stock runs out, new credits arrive the following month.
Apple billing
- Payment: charged to your Apple account when you confirm the purchase. Prices in euros, taxes included.
- Automatic renewal: the annual subscription renews unless cancelled at least 24 hours before the current period ends. The charge is taken within the 24 hours before renewal.
- Manage or cancel: at any time under Settings, Apple ID, Subscriptions, or at apps.apple.com/account/subscriptions. Cancellation takes effect at the end of the paid period, with no refund of the remaining time.
- Price changes: Apple notifies you and asks you to confirm before any new price applies.
4. Analysis credits
Credits are personal, non-transferable and may not be used commercially. Credits granted on activation are not refunded if you cancel before using them, and any unused credit is lost when the subscription period ends.
An anti-abuse mechanism, based on identifiers encrypted in the Apple Keychain, prevents activation bonuses from being claimed again through a reinstall. That data stays on the device and is never transmitted.
5. External services
FramIQ may mention in-person consultations or services offered by Gaspard Blanc. Those services are entirely separate from the application, do not go through Apple in-app purchase, and have their own terms and pricing.
6. Intellectual property
All FramIQ content, including the analysis engine, algorithms, interface, graphics and text, is the exclusive property of Gaspard Blanc and protected by intellectual property law.
The application is licensed for personal, non-commercial use. Any reproduction, distribution, modification, decompilation or reverse engineering is prohibited. Generated PDF reports carry a personal-use watermark and may not be redistributed or exploited commercially.
7. Third-party services
FramIQ includes Firebase Crashlytics, provided by Google, solely for crash detection. No other third-party service, no advertising SDK and no audience measurement SDK is built into the application. Details in the privacy policy.
8. Account and authentication
FramIQ uses Sign in with Apple. No password is stored. By creating an account you accept Apple's terms and privacy policy.
You are responsible for the security of your Apple ID. You can delete your account at any time from the application; deletion permanently erases your data within 30 days and does not entitle you to a refund of an active subscription, which must be cancelled with Apple first.
9. Medical disclaimer
FramIQ is not a medical device. The recommendations, angles and adjustments provided are informational and educational. They rest on established biomechanical references and do not replace medical assessment, diagnosis or treatment. Always consult a healthcare professional before significantly changing your position, particularly if you have an injury or a pre-existing medical condition.
10. Legal guarantee of conformity
FramIQ is digital content within the meaning of articles L224-25-12 and following of the French Consumer Code. You therefore have the benefit of the legal guarantee of conformity: the application must match what is advertised and remain compliant for the whole period you have paid for.
- For the one-off purchase, the guarantee runs for two years from supply. During the first twelve months, a defect is presumed to have existed at the time of supply: you have nothing to prove.
- For the annual subscription, the guarantee runs for the whole subscription period, and the presumption applies over the same period.
- Where the content is not compliant, you may require it to be brought into conformity free of charge, within a reasonable time and without major inconvenience to you. If that is impossible, you may obtain a price reduction or terminate the contract.

11. Limitation of liability
We take reasonable steps to keep FramIQ working properly, without being able to guarantee an uninterrupted or entirely error-free service: it also depends on your device, its iOS version and the quality of your footage.
We cannot be held liable for indirect loss, that is, loss that does not flow directly and immediately from a failure on our part.
However, and notwithstanding anything else in these terms, nothing here excludes or limits: the legal guarantee of conformity, the guarantee against hidden defects under articles 1641 and following of the French Civil Code, our liability for personal injury, or our liability for gross negligence or wilful misconduct.
12. Right of withdrawal
Purchases are concluded with Apple, which is the seller. Under article L221-28, 13° of the French Consumer Code, the fourteen-day right of withdrawal does not apply to digital content supplied immediately, once performance has begun with your express consent and you have acknowledged losing that right: that is what you confirm at the moment of purchase on the App Store.
Refund requests go directly to Apple, at reportaproblem.apple.com. None of this affects the legal guarantee of conformity described in article 10.
13. Changes
These terms may be updated at any time. Where a change is significant, you will be told through the application. Continuing to use FramIQ after it takes effect counts as acceptance.
14. Governing law and disputes
These terms are governed by French law.
As a consumer resident in the European Union, you keep the benefit of the mandatory consumer protection rules of your country of residence. In the event of a dispute you may bring proceedings, at your choice, before the court where you live or the court where we are established.
